NEW DELHI: The Supreme Court (SC) on Wednesday listed Bharat Rashtra Samithi (BRS) leader K Kavitha‘s plea challenging her arrest in a money laundering case relating to Delhi excise policy irregularities matter to be heard on Friday, March 22.
Kavitha on Tuesday withdrew her plea from the Supreme Court challenging summons by Enforcement Directorate and filed a fresh writ challenging her arrest. Kavitha in her petition has challenged her remand as well and said the remand order doesn’t adhere to Article 141 which states that the law declared by the SC shall be binding on all courts within the territory of India. Kavitha in her plea also challenged section 19 (1) of the PMLA Act.
Kavitha was arrested by ED on March 15 from Hyderabad over Delhi excise policy and was taken to Delhi. She had earlier approached the apex court challenging summons issued by the agency. On Tuesday, however, she withdrew her pending plea before it came up for hearing.
Two days after the arrest of Kavitha, daughter of former Telangana chief minister K Chandrasekhar Rao, ED named Delhi CM Arvind Kejriwal and former deputy CM Manish Sisodia as her co-conspirators in the alleged liquor policy scam.
Rebutting ED’s claims, AAP said, “On earlier occasions too, ED had released such blatantly false and frivolous statements which show that instead of being a neutral investigative agency, it is working like a political wing of BJP.” It said ED’s charges are a ‘desperate attempt’ to malign the image of Kejriwal and Manish Sisodia by ‘planting falsehoods and creating a media sensation’ every day.
ED, which has filed six chargesheets in the excise policy case, has arrested 15 people and claims to have traced ‘proceeds of crime’ of Rs 129 crore, attaching assets of an equivalent amount.
