MUMBAI: Bombay high court has released on bail a woman (24) who was booked for killing her nearly four-month-old daughter in March last year allegedly due to harassment by her husband and his mother.
“The trial is unlikely to conclude any time soon and is likely to take considerably long time. The present applicant does not have any criminal antecedents.The applicant is a young lady and has been incarcerated for more than 9 months. The prosecution’s case is entirely based on circumstantial evidence,’’ said Justice Madhav Jamdar on Monday while allowing Yukta Rokade’s bail plea.
According to the prosecution, on March 21 an FIR was lodged against an unknown person by Gangapur police station, Nashik district, on Rokade’s complaint. She stated that on March 20 around 7 pm, she was in her house alone with her daughter. A middle-aged woman knocked on the door and enquired about her mother-in-law. Rokade asked her to return after some time. She claimed that the woman suddenly came from behind her and placed a handkerchief on her nose, knocking her unconscious. When Rokade regained consciousness, she found her baby bleeding through her nose and mouth and her neck was severed from the side with a sharp weapon. During investigation, the police found from CCTV that the unknown woman was not present in the vicinity at the relevant time. Medical examination showed that Rokade’s injuries were self-inflicted. Rokade was arrested on March 22. On May 30, the additional sessions judge rejected her bail plea. Her bail plea in HC said she is “innocent and was falsely implicated.”
Justice Jamdar noted that the prosecution’s case is that the mother killed her daughter with a knife “as she used to be more with her husband and her mother-in-law.” Prosecutor Veera Desai said Rokade provided false information and the child was “3 months, 18 days old.” Rokade’s advocate Aniket Vagal said she was suffering from depression post-delivery and there were frequent quarrels between her, her ‘alcoholic’ husband and mother-in-law.
Justice Jamdar noted that in the May 30 chargesheet there are 11 witnesses. Vagal said as several witnesses are residing in the same locality, she will stay with a relative in Dhule district.
“The applicant does not appear to be a flight risk. Accordingly, she can be released on bail by imposing conditions,” said Justice Jamdar.
He directed Rokade release on Rs 10,000 personal bond with two sureties of the same amount. She will not directly or indirectly induce, threaten or promise any person acquainted with facts of the case to dissuade them from disclosing facts to the court or police. She is barred from entering Nashik district except for reporting to the police and for trial.
