Can court review governor’s decision? High court to decide | India News – Times of India

HYDERABAD: Can the judiciary review a decision of the governor, or does the Constitution bar judges from hearing such cases? This crucial question will be answered by the Telangana high court in two writ petitions filed by Kurra Satyanarayana and Dasoju Sravan Kumar.
The two had been nominated as Legislative Council members under the governor’s quota by the previous BRS government.However, governor Tamilisai Soundararajan had rejected their names, after which both moved the HC. They feared the new Congress government would fill the seats as the cases were being heard.
The state government can file objections, a bench of Chief Justice Alok Aradhe and Justice S Nanda said. Allaying fears, the bench said it was a gentlemen’s agreement. “The state will not do anything till the next date of hearing,” it said while posting the matter to January 24.
The governor’s secretary has raised an objection over the maintainability of the petition under Article 361, which states that a criminal proceeding cannot be instituted in a court against the governor during his or her term in office.
